The Costume Ballot respects the rights of others and asks users to do the same. This page describes what the Site does and does not use, and how to report an infringement. The operator is Cryptoes LLC.

1. What the Site uses

• Nothing on the Site is licensed audio, artwork, or lyrics. The Site does not host recordings, album covers, lyrics, liner notes, or band photographs.
• Song, album, and artist names appear as text to identify music. Use of a name does not imply endorsement by its owner. Trademarks belong to their owners.
• The Site's graphics, text, and design are original to the Site or used with permission.
• Facts about Phish history come from public sources, chiefly Phish.net, and link to their source. The Site does not republish setlists. See also phish.com.
• Users can post text, not files or images. Do not post copyrighted material you do not have the right to use.

2. Designated agent

Notices of claimed infringement go to the Operator's designated agent:

The Operator has designated the agent above to receive notices of claimed infringement. Registration of this designation with the U.S. Copyright Office is pending.

3. How to send a notice of claimed infringement

Under 17 U.S.C. 512(c)(3), a notice should be in writing and include:

1. A physical or electronic signature of a person authorized to act for the owner of the right said to be infringed.
2. Identification of the copyrighted work claimed to be infringed, or a representative list if one notice covers several works.
3. Identification of the material claimed to be infringing, with enough information (such as the page address) for the Operator to find it.
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner.

A notice that leaves out these items may not be acted on. Knowingly misrepresenting that material is infringing can carry liability under 17 U.S.C. 512(f). This page is general information and not legal advice.

4. What the Operator does with a notice

When a notice that substantially meets the elements above arrives, the Operator will act promptly to remove or disable access to the material, tell the user who posted it, and give the user a chance to send a counter-notice. The Operator keeps a record of each notice.

5. Counter-notice

If your content was removed and you believe that was a mistake, you may send a counter-notice to the designated agent above. It should include:

1. Your physical or electronic signature.
2. Identification of the material that was removed and where it appeared before removal.
3. A statement, under penalty of perjury, that you have a good faith belief the material was removed because of a mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district of your address (or, if outside the United States, any district where the Operator can be found), and that you will accept service of process from the person who sent the original notice.

The Operator will send a copy of the counter-notice to the person who filed the original notice. Unless that person tells the Operator within 10 business days that they filed a court action against you, the Operator may restore the material no sooner than 10 and no later than 14 business days after receiving the counter-notice.

6. Repeat infringers

The Operator has a policy of closing, in appropriate circumstances, the accounts of users who are repeat infringers. As a working rule, an account with three valid notices that were not successfully countered is subject to closure. The Operator keeps records to apply this rule.

For trademark, privacy, or other complaints about content on the Site, write to [email protected]. The process in this page is for copyright. The Operator will review other complaints under the Terms.
